Calstock Parish Neighbourhood Development Plan

The Independent Examiner for the Calstock Parish Neighbourhood Development Plan has instructed us to carry out a further three week period of consultation, on proposed modifications to policies LISF 5 – LOCAL GREEN SPACES and HP1- SETTLEMENT DEVELOPMENT BOUNDARIES which will run from 18 March 2021 until 8 April 2021.

This is because the qualifying body has submitted proposed modifications in response to the Examiner’s questions for clarification.

This is not a further consultation on the plan as a whole and representations should be confined to comments on these two policies.

Calstock Parish Council formally submitted their Neighbourhood Plan to Cornwall Council.  It was submitted on 5 June 2020.  This was for their designated Neighbourhood Development Plan Area. Under the Neighbourhood Planning (General) Regulations 2012 (as amended).

Cornwall Council is consulting on the plan for the Calstock Parish area with:

  • residents
  • other interested stakeholders

The Consultation will run between Thursday 9 July until 1 October 2020. This is for an extended twelve-week period. The statutory consultation has been adapted due to the national Covid-19 crisis. It takes into consideration the latest Planning Guidance. The guidance is from The Ministry of Housing, Communities and Local Government.

The plan proposal includes a copy of a map and statement. This identifies the area where the proposed Neighbourhood Development Plan relates to. The following documents:

  • a consultation statement
  • the proposed Neighbourhood Development Plan
  • a statement explaining how the proposed Neighbourhood Development Plan meets the requirements of paragraph 8 of Schedule 4B to the 1990 Act. (The Basic Conditions Statement)

Next Steps

Following the twelve-week consultation period, the representations will be collated. They will then be sent for independent examination. You may also request to be notified of the local planning authority’s decision. This is under Regulation 19 (the outcome of the independent examination of the plan.) If the Examiner believes that the Neighbourhood Plan meets all its requirements a referendum will take place. This will allow residents to decide whether the Neighbourhood Plan should be used by the Council to determine planning applications in the Calstock parish area.

How we use your information

The data is collected by Cornwall Council as the data controller. It is collected under the data protection principles contained within the Data Protection Act 1998.  The information you provide will be used for the preparation of the Neighbourhood Plan. As well as associated planning policy guidance documents.  Full comments, including addresses will also be available to view. These can be viewed by any interested party upon request. 

Regulation 17 of the Neighbourhood Planning (General) Regulations 2012 requires all representations received by Cornwall Council to be submitted to the Examiner.  All personal information collected by Cornwall Council is held safely in a secure environment. It will be kept in accordance with our retention policy. All correspondence will be kept for up to 4 years from adoption of the plan.  At which point all correspondence will be deleted. By submitting your response you are agreeing to these conditions.

Calstock Parish Council submitted an application and map to designation their Neighbourhood Area. This was submitted on 18 July 2013. Cornwall Council consulted residents and other interested stakeholders on the designation. The consultation ran between 19 July and 30 August 2013. Copies of the application letter and statement were made available to view during the six week consultation. The statement explains how the Parish Council and Neighbourhood Area met the conditions of Section 61G(2) of the Town And Country Planning Act 1990.
