The St Enoder Neighbourhood Development Plan Referendum is currently postponed. Regulations linked to the Coronavirus Act 2020 mean that no elections or referendums can take place until 6 May 2021. This includes neighbourhood planning referendums. These provisions will be kept under review and may be amended or revoked in response to changing circumstances. 

The Ministry of Housing, Communities and Local Government have updated the current planning guidance to set out that neighbourhood plans awaiting referendums can be given significant weight in decison-making. 

Judicial Review - Pre-action 

Kingsley Developments (SW) Ltd have issued a pre action protocol letter challenging the Cornwall Council decision, dated 14 November 2019, to modify the neighbourhood plan according to the Examiner’s recommendations, publish the plan proposal decision and proceed to referendum.

The St Enoder Neighbourhood Development Plan has been successful at examination. The independent examiner appointed was Andew Ashcroft and the documents were sent to him on 2nd August 2019. Cornwall Council recieved the examination report on 1st October 2019.

The NDP was modified in line with the Examiner’s recommendations with some minor modifications to the policy justification as made by Cornwall Council and St Enoder Parish Council for clarification purposes. The decision notice was published on 14 November 2019, but there were some inconsistences between the officer report and the amended NDP which were identified by an interested party.

An initial assessment of the neighbourhood plan, background evidence and representations was completed. Following this, the examiner raised a number of initial questions. The questions and response can be viewed below.

The St Enoder Neighbourhood Development Plan was formally submitted to Cornwall Council on 7 May 2019 for their designated Neighbourhood Development Plan Area, in accordance with the Neighbourhood Planning (General) Regulations 2012 (as amended).

Cornwall Council consulted residents and other interested stakeholders on the plan for the St Enoder Parish area. Consultation ran between Thursday 20 June and 1 August 2019 for six weeks. During the consultation you could comment by emailing us at , by typing the Neighbourhood Planning application number PA19/00012/NDP into the online planning register, or send us your response in writing to the address below.

The plan proposal includes a copy of a map and statement which identifies the area to which the proposed Neighbourhood Development Plan relates; a consultation statement; the proposed Neighbourhood Development Plan, a statement explaining how the proposed Neighbourhood Development Plan meets the requirements of paragraph 8 of Schedule 4B to the 1990 Act (the Basic Conditions Statement and the Consultation Statement appendices 1 – 9 documents (available on the CC website).

St Enoder Parish Council submitted an application and map to designation their Neighbourhood Area. This was submitted on 5 August 2013. Cornwall Council consulted residents and other interested stakeholders on the designation. The consultation ran between 16 August and 27 September 2013. Copies of the application letter and statement were made available to view during the six week consultation period. The statement explains how the Parish Council and Neighbourhood Area met the conditions of Section 61G(2) of the Town And Country Planning Act 1990.
