The below are examples of the standard documents used in relation to Section 38 and Section 278 applications and Agreements and APC's Bonds.

Performance Bonds

The Council is currently reviewing its Bonds policy, in the interim Cornwall Council will accept Bonds from NHBC and any companies that meet the accepted rating range from one of the below rating agencies.

Cash Bonds

Before a cash Bond will be accepted, as part of identity verification checks, we require details of who will be securing the payment. The information required is set out in the Getting to Know Your Customer and ID verification Checklist documents. 

Amendments to the Advance Payments Code Bond wording can be requested but any amendments will need to be approved by Cornwall Council’s Legal Services Department before inclusion in the Bond document. A fee is payable per amendment request which must be secured with the Council before any amendments to the standard wording will be considered, this is payable irrespective of whether or not the amendment is accepted. Please note that time limited APC Bonds will not be accepted by the Council.

If an engrossed APC Bond is required please contact the case officer detailed on the APC Notice issued.

Large documents (up to 2gb) submitted with Section 38 and Section 278 applications can be uploaded to the Councils FtP server. If you have not used this facility before please contact the Estate Roads team to be added to the 'whitelist'. Please note that we are unable to download documents from third party servers.
